State Hospital for the Crim inally Insane In its place may come re gional treatment centers or community centers for out patient services This was suggested yes terday in an announcement of the seminars by Kenneth Caver state director of mental health and mental retardation GAYER SAID a 116800 grant from the Law Enforcement Assistance Administration will be used to conduct major seminars Participating will be members of the state's judi cial branches members of psychiatry division and other groups concerned with the mentally disturbed criminals Lima State Hospital target for criticism in re cent months is the only major state institution used solely for treatment and confinement of mentally disturbed criminals CRITICS HAVE charged that mentally retarded pa tients do not belong in the same institution with those judged criminally insane During the recent investi gations at the hospital an Allen County Common Pleas judge ordered men tally retarded patients moved elsewhere these seminars we hope to develop a better understanding of needs for the mentally dis turbed offender" Gaver said "Our hope is to estab lish proposals which will serve as alternatives to our present system" HE EXPLAINED that such alternatives to be stud ied at the seminars to be gin in five major Ohio cities this fall include regionali zation of treatment centers instead of one large state with court action plans to order Scioto County to follow through on a prop tax reassessment it thinks may be unconstitu tional The object Is to put yet another lest before the Ohio Supreme Court which that case under the Maloney bill" Sawicki said Sen Michael Maloney 7 of Cincinnati authored the bill that would irermil counties to make the reap praisals only when the next one was due rather than immediately Counties now reappraise property for tax purposes once every six years The Maloney law got around the order that all property be reap praised at 33 of value The board reacted to on earlier Supreme Court deci sion that appraisals must be uniform The Iward set the rale It was the second time in three years that a Maloney bill kept tho board from fol lowing court orders He introduced a similar bill in 1969 that delayed un til 1972 the carrying out of Supreme Court orders for uniform appraisals Park Investment took the board back into court on a contempt citation contend ing it did not follow court orders The court dismissed the oentempt action saying the board had no choice but to follow but at the same time ruled the law unconstitutional Maloney has contended that counties would have their tax structure shat tered if the 35 of true val ue order went into effect immediately Most counties tax below that rate buf several arc above In addition there nro varying rates for differ ent tyics of property within a county "We take the view" said Sawicki "that when the leg islature enacts a law that conflicts with our rule we have to take the provisions of tho law to be superior" He said the board's plan was to approve an abstract In conflict with its rules providing it Is free of tech nical errors "THEN WE HAVE rea son to believe that Park In vestment will bring an action in the Supreme Court that will get the constitu tionality of the law squarely before the court" he added Park Investment lawyers could not Ixj reached for comment but sources said they already knew of the plans for a test and have the necessary legal chal lenges prepared Park Investment a (level opment firm has contended successfully throughout tho years that the fact some of Its property
